Sales and delivery terms
1. Seller and products
The seller and contracting party is LaFig Miniatures, SAS, capital 2 000 EUR — 173 rue de Courcelles, 75017 Paris, France — SIREN 130807324 — SIRET 13080732400012 — RCS Paris 130 807 324 — TVA / VAT FR45130807324 — Thomas Givert, represented by its president Thomas Givert. Contact and complaints: [email protected] — +33 6 66 79 04 75, or post to the registered address above. Shop: https://lafigminiatures.com. LaFig sells and collects payment in its own name, including for a sculptor’s brand shown on the site. The creator is identified separately; LaFig is responsible for delivery, applicable guarantees and refunds.
Products are downloadable digital STL files, individually or in packs, not physical miniatures. The product page states contents, version, scale, variants, any supports, formats and known compatibility requirements. Painted illustrations and scenery are not supplied as physical objects. Suitable software and equipment or a printing provider are needed. No recurring subscription is included. The selected licence defines permitted use.
Earlier Kickstarter, Patreon, Cults3D or other platform acquisitions retain their origin and previously granted rights. Linking them to a library is not a new sale. An account or Professional status alone grants no Merchant rights.
2. Prices and ordering
Commercial base prices are in euros excluding tax. The price including applicable taxes for the declared country, discounts and total payable are shown before confirmation; consumers see the tax-inclusive price. French VAT is 20 % when applicable. Country, billing details and relevant business tax evidence may be required. A Merchant licence is not evidence of a VAT exemption. Payment is unavailable for unsupported countries or tax situations.
Select products and a licence, correct the basket, review the summary, then accept these terms and the express immediate-delivery choices. The payment button entails an obligation to pay. PayPal is the payment method currently offered; no other provider is promised as available. Payment is due on ordering. Your bank’s currency conversion charges follow your agreement with that bank; internal partnership fees are not added to your order.
The contract is concluded on confirmation with accepted payment. A durable confirmation includes the products, prices, full terms and licence version and digital-delivery choices. Later catalogue changes do not rewrite an earlier order. Unconfirmed payment does not give paid access. Contact LaFig with the reference if payment or delivery fails; payment must not be retained without delivery or a refund that is due.
3. Immediate delivery and library
Files become available after payment confirmation and the expressly requested start of digital delivery. This offer has no fourteen-day waiting option. A personal link or library provides the purchased archive; an expired technical link does not require repurchasing. The delivered archive version and associated updates remain identifiable.
Personal purchases can be made without a prior account. After payment, access is associated with the order email. To retrieve files on another device or claim an existing library, verify the email and choose your own password. Merely typing an address never grants another person’s history. Free Samples require a verified account and remain for personal use. Registration, purchase and downloading do not automatically subscribe you to a newsletter.
For each LaFig purchase, library access is guaranteed for at least five years from purchase or later first supply, without automatic expiry then. LaFig may maintain an equivalent interface without repurchasing. Permanent closure is announced at least three months beforehand with an effective means of retrieving files and evidence, without shortening any guaranteed period. The acquired licence is separate from the library service. Keep a local copy too.
If content is not supplied, ask LaFig to supply it. Failure without undue delay or within an agreed additional period permits termination; immediate termination remains available in statutory cases, including refusal or a missed essential date. Refunds due are made without undue delay and within fourteen days after notification of termination, using the original means unless expressly agreed otherwise without fees.
4. Withdrawal and statutory guarantees
Consumers generally have fourteen days after concluding a distance contract to withdraw without giving a reason. To receive paid digital content immediately, before performance you must expressly consent to its start before that period ends and acknowledge losing the withdrawal right when performance begins. LaFig confirms these choices on a durable medium. Overall acceptance of terms alone is insufficient. Without these choices this immediate-delivery order cannot be placed and payment is not requested.
Loss of withdrawal does not remove remedies for faulty or undelivered content. Send a declaration or request by email or post. In My orders (https://lafigminiatures.com/#/commandes), Help / withdrawal lets the signed-in owner submit a declaration and retain a dated acknowledgement. Submission does not determine legal eligibility. Any refund is handled by LaFig, not automatically by the form.
Optional withdrawal form: To LaFig Miniatures, 173 rue de Courcelles, 75017 Paris, [email protected]. I withdraw from the contract for the stated product and order reference, ordered on (date). Include name, address, date and signature only on paper. Any unambiguous statement is sufficient. A valid withdrawal is refunded within fourteen days of notification, by the original means unless expressly agreed otherwise without fees; stop using the cancelled content, while other purchases remain intact.
For one-off digital supply, the French statutory conformity guarantee covers defects appearing within two years of supply; during the first year you need prove the defect, not its date of origin. Necessary conformity updates must be provided. For the continuous library service, conformity applies throughout its promised supply period, at least five years per purchase; during that period you need establish the defect, not when it arose. Correction must be free, without undue delay or major inconvenience. You may obtain a price reduction or termination if correction is refused, unjustifiably delayed, costly, substantially inconvenient or unsuccessful; a sufficiently serious defect permits an immediate remedy. A minor defect only permits termination where no price is paid. Unavailability during correction suspends the remaining guarantee. These rights arise under French Consumer Code L.224-25-1 to L.224-25-31; bad-faith obstruction may incur the civil fine in L.242-18-1 (up to EUR300,000, potentially 10 % of average annual turnover). Hidden-defect rights under Civil Code1641–1649 also apply for two years from discovery, allowing a reduction or refund against relinquishing the content.
LaFig examines printing failures according to their cause rather than presuming user fault. New, separate artistic creations are not automatically included. Contact LaFig with reasonably useful evidence to seek a remedy. No extra commercial warranty is offered. Licence terms do not exclude mandatory rights.
5. Evidence, law and disputes
The terms supplied and accepted at ordering remain applicable to that order. Confirmations, invoices and acquisition evidence are retained for legal duties and protection of acquired rights. Electronic contracts of at least EUR120 are archived for ten years under the applicable rules, accessible on request. Privacy: https://lafigminiatures.com/legal/en/privacy.html.
After an unresolved prior written complaint to LaFig, consumers may use the free mediation service Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net/, subject to eligibility rules, including referral within a year of the written complaint. Mediation is optional and does not prevent court proceedings.
French law applies without depriving consumers of mandatory protections of their country of residence. Jurisdiction follows the law; consumers are not forced to use Paris courts. Business customers retain remedies applicable to their status; a licence alone does not extend consumer-only rules to them. Translations are available before ordering. No clause overrides applicable mandatory rights.
